Terms of Service

By using Milestone Journey+ ("the App", "our service"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Milestone Journey+, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old to create an account. By using the App, you represent that you are at least 18 years old and have the legal authority to enter into these Terms.

3. Account Registration

You are responsible for:

• Providing accurate registration information
• Maintaining the security of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. Subscription and Payment

Free Tier

We offer a free tier with basic functionality, limited to one child profile and core tracking features.

Premium Subscription

Premium subscriptions are billed monthly ($4.99/month) or yearly ($39.99/year) via Stripe. Subscriptions automatically renew unless cancelled before the renewal date.

Cancellation

You may cancel your subscription at any time through the Manage Subscription option in Settings. Cancellation takes effect at the end of the current billing period. You retain access to premium features until then. No refunds are issued for partial periods.

Refunds

All purchases are final and non-refundable except where required by law.

5. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to any part of the service
• Upload malicious content or content that violates intellectual property rights
• Use the App to harass, threaten, or harm others
• Reverse engineer, decompile, or attempt to extract source code
• Use automated means to access the service without permission

6. User Content

You retain ownership of all data you upload, including photos and tracking information ("User Content"). By using the App, you grant us a limited license to store, transmit, and display your User Content solely to provide the service to you and the family members you invite.

7. Family Sharing

When you invite family members, they gain access to the children's data you specify. You are responsible for who you invite. You may revoke access at any time.

8. Medical Disclaimer

Milestone Journey+ is a tracking tool, not a medical device or substitute for professional medical advice.

• Information provided in the App is for tracking and informational purposes only
• WHO growth chart percentiles are reference data, not a medical diagnosis
• Always consult your child's pediatrician for medical advice, diagnosis, or treatment
• Do not delay or avoid seeking medical advice based on information in the App

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time with reasonable notice.

10. Data and Backups

While we use reliable cloud infrastructure (Google Firebase) for data storage, we recommend you periodically export your important data. We are not liable for data loss.

11. Intellectual Property

The App, including its design, code, branding, and content (excluding User Content), is owned by us and protected by copyright and other intellectual property laws.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability is limited to the amount you paid in the past 12 months.

13. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the App or violation of these Terms.

14. Account Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms.

15. Changes to Terms

We may update these Terms occasionally. Continued use of the App after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict of law principles.
